The family of Abdulraham Kateregga who was shot dead during by CMI Operatives on allegations of masterminding the killing of former Byende DPC Afande Muhammad Kirumira has dragged General David Muhoozi the commander of UPDF, General Jeje Odongo the Internal Affairs Minister and the Attorney General to court.
The brother of the deceased, Farouq Kaweesa through his lawyer Ladislaus Rwakafuzi accuses the CMI operatives of murdering his brother in a cold blood.
In affidavits all sworn before court that the UPDF found Kateregga at his home in Luyinja Namungoona Rubaga Division and shot him without a warning.
He further added that it was UPDF which General Muhoozi commands that intentionally caused the death of Kateregga who was not on death sentence pronounced by a competent court.
He noted that the killing was violent and unnatural and therefore, is a subject of an inquest under the inquest Act. Kaweesa wants court to instruct the internal Affairs minister Jeje Odongo to appoint a coroner to inquire into the lawfulness of the death of his brother. He also wants court to issue a Habeas corpus against General Muhoozi to produce a One Mariam Kateregga.
He also added that on the day UPDF killed his brother, the same killers who were putting on UPDF uniforms also kidnapped Mariam Kateregga a wife to Kateregga. He said that Mariam was found at his home in Luyinja Namungoona Rubaga Division where they killed her husband from. He said that from that day up to now the family of Mariam has never seen or heard of her whereabouts which violates her human rights.
He stated that he was informed by his lawyer Rwakafuzi that it’s illegal and unconstitutional for any person to be detain the other in un gazette custody and asked court to order Muhoozi to produce Mariam before a competent court because she has never appeared before any judge or magistrate as stated in the constitution.
He said that Mariam left 15 children, 13 of them are her biological children and 2 are for her co-wife. He added that the children are still too young because the oldest is 17 years while the youngest is 2 years and they don’t have anybody to take care after them. Court has not yet set a date to hear the application.
